End-User License Agreement
Effective date: August 12, 2026
1. Agreement
This End-User License Agreement ("EULA") is a legal agreement between you and Epohk LLC ("Epohk," "we," "us," or "our") for use of the Epohk mobile applications, website, and related software (collectively, the "App"). By downloading, installing, accessing, or using the App, you agree to this EULA. If you do not agree, do not use the App.
This EULA works together with our Terms of Use and Privacy Policy. If there is a conflict about your license to use the App software, this EULA controls for that license; otherwise the Terms of Use apply to your use of Epohk services.
2. License grant
Subject to this EULA, Epohk grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, solely for your personal or internal business use in connection with Epohk's services.
If you obtained the App from Apple's App Store or Google Play, your use is also subject to the applicable store's terms. App Store / Google Play are not parties to this EULA and have no obligation to provide maintenance or support for the App, except as required by applicable law.
3. License restrictions
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the App.
- Reverse engineer, decompile, or attempt to extract source code from the App, except to the extent such restriction is prohibited by law.
- Bypass, disable, or interfere with security, usage limits, or payment / compliance controls in the App.
- Use the App to build a competing product, or to scrape or harvest data except as expressly permitted.
- Use the App for any unlawful, fraudulent, or abusive purpose.
4. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the App. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Certain payment and verification features may require additional eligibility checks and acceptance of partner terms.
5. Payments and financial features
The App may allow you to send, request, or receive payments, link bank accounts, and complete identity verification. Payment processing, settlement, and related banking services are provided through regulated third-party partners. Epohk is not a bank. You are responsible for the accuracy of payment instructions and for complying with applicable law.
Nothing in the App is legal, tax, accounting, or investment advice. Fees, if any, will be disclosed in the App or in a separate agreement.
6. Your content
You retain ownership of content you submit through the App. You grant Epohk a non-exclusive, worldwide license to host, process, transmit, display, and reproduce that content solely as needed to provide, secure, and improve the App and related services, and as described in our Privacy Policy.
7. Updates and availability
We may provide updates, patches, or new versions of the App. Some updates may be required to continue using certain features. We do not guarantee that the App will be available at all times or on all devices.
8. Intellectual property
The App, including software, branding, and documentation, is owned by Epohk and its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.
9. Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with it. You may stop using the App at any time and uninstall it. Upon termination, you must cease all use of the App and delete copies in your possession. Sections that by their nature should survive will survive termination.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPOHK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THIS EULA OR THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS EULA OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP OR RELATED SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.
12. Third-party beneficiaries (Apple)
If you downloaded the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. Apple is not responsible for the App or its content, for addressing claims relating to the App, or for investigating or defending intellectual property infringement claims related to the App, except as required by applicable law.
13. Governing law
This EULA is governed by the laws of the State of Delaware, excluding conflict-of-law rules, except where mandatory consumer protection laws of your jurisdiction apply. Courts located in Delaware have exclusive jurisdiction over disputes, unless otherwise required by law.
